Minutes of CEC meeting held on 12-13 April 2012 at Mumbai


MINUTES OF THE CEC MEETING HELD AT MUMBAI ON 12 AND 13 April 2012


The CEC meeting of the NBOA was held on 12 and 13 April 2012 at Mumbai.
The meeting was chaired by Sri U.K.Mohanty, President, NBOA and was attended by the undersigned. List of participants is enclosed.

 1. While inaugurating the meeting the President highlighted the onslaught of the management on NBOA and explained how every step by the NBOA is taken as a personal affront. He said that management perhaps has started questioning the need of having NBOA.
2. GS concurred with the views of the President and cited the example of transfer of President and other office bearers of NBOA keeping aside the set procedure and practices of transfer. He urged the members to tell frankly whether they feel that there is a need to have NBOA and if yes what should be the strategy to make it strong. He also said that this meeting had to be convened to give a strong message to the management.
3. All the CEC members were unanimous in their views that the need of having NBOA is never questioned by members and they have full faith in it. Most of the CEC members informed that they have convened meetings at their respective units and all have reiterated their support to the Central Unit. Members are getting disenchanted because issues are not being solved. Members opined that leadership should have faith in their members and prepare for stronger action.
4. Vice President was of the view that while regular discussion is good but having such frequent meetings give wrong signal to the members that the leadership itself is confused. He advised the CEC members to use the net to express their opinion on various issues.
5. CEC unanimously condemned the move of the management to transfer the President and other office bearers and sought immediate discussion with the management on this issue. Transfer of President is a direct attack on NBOA and NBOA should not accept it lying down.
6. There were suggestions to go to the media and expose the management. They questioned the management on non fulfillment of various demands already agreed upon, e.g. EOL, show cause to DRs, disgraceful CRS to one of the member, career progression of grade A and B officers, etc. Members requested the Central Unit to take up cases of harassment, eg. LTC related and other financial recoveries and suspension cases of officers. Members also suggested to make the NBOA financially strong and to join hands with NBEA as issues are common. Members urged the Central Unit to hasten the process of registration of NBOA and to meet the FM at the earliest by utilizing the good offices of the patron.
7. It was told by the GS that meeting with FM may materialise in few days. He also informed that the patron is ready to brief the media himself whenever a press conference is called in Delhi. So far NBOA has deliberately not gone out of the walls of NBOA with its grievances as this may lead to tarnishing of NABARD’s image, but if the management is not at all interested in solving the issues across the table and is hell bent on continuing with its anti officers policies and actions then there is no other option but to reach out to all those within and outside the boundary wall of the organization. He further added that the patron at the New Delhi CEC meeting has advised and appreciated the move of the NBOA to restrain itself from approaching the Media and has indicated that once he discusses the current situation with Hon’ble Finance Minister, he will then himself, if required, take the matter to Media and others.
8. The LTC issue was discussed threadbare. It was told that a lot of effort was made to convince the management and cases were perused. However, the management has not responded positively. The CEC was of the unanimous view that officers are being harassed in the name of LTC and the NBOA should protest as management has been unkind, unfair, biased and non transparent on this issue. As GS has already appealed to the chairman we may wait for 15 days and thereafter write to the Bank to give evidence on the basis of which recoveries have been effected from a large number of officers. It was also decided to support those members who wishes to challenge the Bank in this regard by extending NBOA’s moral, organizational and if required, financial support.
9. The CEC decided to immediately approach the Chairman on transfer of President and the issue of show case to DRs. As Chairman was going to New Delhi to attend a meeting in the Finance Ministry that day itself he was not available.  The entire CEC met the CGM, HRMD and lodged its protest on transfer of President and requested him to withdraw the transfer order as a goodwill gesture towards the NBOA. He was also requested to withdraw the show cause notices to DRs as they had responded to the call as members of NBOA. CGM gave a patient hearing and assured to do the needful in case of all genuine cases.
10. The issue of Presidents transfer was again discussed on 13.4.12 and it was decided that if Bank does not withdraw the transfer order the NBOA will have no option but to proceed on agitation. The patron will be requested to intervene on the issue and all further organizational moves on this issue will be decided in consultation with the Patron. Lunch time demonstration will be organised at all units on 27.4.12. It was also decided to go to the media on the issue of BCG and its recommendations in the 1st quarter of May, 12. NBOA will also write to GOI with copy to RBI and the Bank in this regard. NBOA shall also approach respective MPs and other stake holders on the likely outfall on NABARDs’ activities and status due to implementation of BCG recommendations.
11. In addition to the above, the following decisions were also taken by the CEC :
i. Units must react whenever there is a case of suspension, etc.
ii. Members who have been denied the benefit of EOL must approach the GRM.
iii. As there is a need to register the Association it was decided that all big units will first register at the local level. Units to take steps in this regard.
iv. To protest against the merger of NBOA and NBSC and departments like ICD and DCRR, GAD and HRMD, ICD and PCD and the move to close some DDM offices which ultimately will lead to stagnation and reduction in staff strength.
v. Units to send the names of members who had not participated in MCL by 17.4.12
vi. Local unit to meet the members of the Board immediately.
vii. CEC directed the Mumbai unit to immediately expel Sri Pavan Vij and Sri S.K Tyagi from primary membership of the NBOA and condemned the misbehavior the two PS officers have meted out to the Organising Secretary on 28/02/2012 during the MCL implementation.
viii. It was decided to call upon those members who could not participate in Mass Casual Leave programme because of leave, tour, etc. to contribute one days salary to the NBOA as a part of solidarity to share the financial burden with majority of the members who lost out on a days salary due to MCL. This was in tandem with our earlier practice too.
ix. It was decided that all dues to the Central Unit including levy will be cleared by 30.4.12.
x CEC also decided to take up the case of Sri VBS Murthy with the management very effectively as his  was a clear case of victimization by the bank unleashed on him on account of his legitimate NBOA related activities.
The meeting ended with a vote of thanks proposed by Sri Nitin Nerurkar, Organising Secretary of NBOA .
